Security Contractor Ordered to Pay $215,633.00 In Restitution to School District

The Special Investigative Unit of RJN Investigations, Inc., has been notified by the San Bernardino County District Attorney’s Office regarding the successful prosecution of the People of California vs. S. Lindsay.  In this case, the school district was experiencing increased gang activity as well as significant vandalism at one of their school sites.   They then hired a private security company to provide additional coverage during the evenings and weekends.  As part of the contract negotiation, the security company had to provide an insurance certificate, reflecting that they had current workers’ compensation insurance coverage on their employees.  Subsequently, one of the security guards employed by the company was murdered while performing his duties on the school property.  The family filed for death benefits through the listed insurance company on the insurance certificate.  The claim was denied since there was no actual policy in place.  A subsequent investigation by the RJN SIU revealed that the owner of the security company had provided a falsified insurance certificate to the school district.  As a result, the school district had to incur all the death benefits and claim costs. The case was subsequently referred to the San Bernardino County District Attorney’s Office by the RJN SIU.  Upon completion of their criminal investigation, the Security firm’s owner was subsequently arrested and charged with several felonies.  After several hearings and delays due to COVID, the owner subsequently entered into a plea-bargaining agreement in which he pled guilty to Penal Code Section 532.  (Theft by false pretenses). As part of the April’s sentencing hearing, the San Bernardino County Superior Court Judge ordered the owner to pay the school district restitution in the amount of $215,633.00.


Formed in 1996, the RJN SIU Division was created to assist California employers, insurance carriers and TPA firms in securing professional assistance so as to detect, investigate and prosecute insurance fraud.  To date, the unit has trained well over 3,500 examiners and the documented referrals by this unit have resulted in over 210 convictions for workers’ compensation insurance fraud in California.  In just the last 3 ½ years, we have secured $1,184,278.00 in court ordered restitution on behalf of our valued clients.
