Drywall Installer Convicted In LA County

The Special Investigative Unit of RJN Investigations, Inc. was notified of the successful prosecution of the People of California Vs. E. Marquez who was employed as a Drywall-Taper in Los Angeles County. The claimant reported that he was working on the second floor when he fell causing injuries. The claimant was placed on modified work duties such as working in a sit-down job with the restrictions that he must wear a walking boot on his right ankle. Throughout the claim the claimant stated that the pain was constant and moderately severe. The claimant stated that he had been unable to drive since the date of injury and has not worked since the date of injury for his employer or any other company. Surveillance obtained by RJN, documented the claimant driving to a construction site, and removing dry wall taping equipment from his car apparently preparing to work which was in contrast to what he reported to his treating doctors and at the time of his deposition. Efforts from RJN determined that the claimant was being compensated at a rate of 22.00 an hour. In February of 2018, our office was advised that the claimant was arrested and charged with four felony charges. Since charges being filed, the claimant attended multiple hearings with COVID-19 delaying the hearings, and in his most recent criminal hearing the claimant pleaded Nolo Contendere to count 4 of PC 459 (Burglary Second Degree) and the other three counts being dismissed. As part of the plea, the claimant has now been ordered to repay restitution in the amount of $11,000.00.
